Consumer Health Data Policy

Effective Date: August 19, 2025

Existence LLC’s (“Existence,” “our,” “we,” or “us”) Privacy Policy describes how Existence handles your personal information generally. Certain U.S. state laws require specific disclosures regarding consumer health data. This Consumer Health Data Policy (“Policy”) supplements our Privacy Policy and describes how we collect, use, and share your consumer health data.

This policy applies only if and when you choose to connect health or wellness tracking devices (such as wearables) or health-related applications to your Existence account. If you do not connect such devices or applications, this Policy does not apply to your use of Existence Services.

This policy does not apply to protected health information as defined by the Health Insurance Portability and Accountability Act (“HIPAA”) AS Existence is not subject to HIPAA.

1. Consumer Health Data We Collect

Consumer health data” is personal information that identifies your past, present, or future physical or mental health status. Existence collects consumer health data to provide wellness insights and help you optimize your time, energy, and well-being through our Services, from the following sources:

Directly from you, when you:

· Create an account and provide personal information including date of birth

· Upload photos or videos through the Services

· Rate your energy levels and provide wellness-related notes

· Set health and wellness goals

From third-party integrations you authorize, including:

· Apple HealthKit (sleep duration, activity metrics, health data)

· Wearable devices (e.g., Oura, Garmin) for sleep and activity data

· Google Calendar API (which may inadvertently contain health-related appointment information)

Through our Services when we generate insights about your wellness patterns

Existence collects the following types of consumer health data:

Information We May Collect:

· Sleep information: Sleep duration, sleep quality metrics, sleep patterns, and sleep-related data from wearables and Apple Healthkit, for example.

· Activity and wellness metrics: Energy ratings, activity levels, wellness patterns across Existence’s four pillars (life, health, sleep, work).

· Health-related calendar data: Calendar events that may inadvertently contain health information (e.g., medical appointments).

· User-generated wellness content: Photos, videos, notes, and goals related to your wellness journey.

· Demographic information: Date of birth, which may be used to provide age-appropriate wellness insights.

· AI-generated insights: Wellness recommendations and patterns identified through AI analysis of your data.

2. Our Use of Consumer Health Data

We use your consumer health data only for the following purposes:

· Wellness insights and personalization: to analyze your sleep patterns, energy levels, and activity data to provide personalized insights and recommendations for optimizing your time and well-being.

· Service functionality: to enable core features including tracking across our four pillars (life, health, sleep, work), generating AI-powered insights, and helping you design time effectively.

· Service improvement: to improve our algorithms, enhance our AI models (using only anonymized and aggregated data), and develop new wellness features.

· Customer support: to assist you with questions about your wellness data and insights.

· Legal compliance: to comply with applicable laws and respond to legal process.

· Safety and security: to protect the security and integrity of our Services.

We do NOT use consumer health data for:

· Marketing or promotional purposes unrelated to our core wellness services.

· Sale to third parties.

· Creating consumer profiles for advertising purposes.

3. How We Share Consumer Health Data

We may share your consumer health data only in the following limited circumstances:

· With AI service providers: We share your data with third-party AI providers to generate wellness insights and recommendations. These providers are contractually required to protect your data and use it only to provide services to us.

· With integration partners: When you connect third-party services (e.g., Apple HelathKit, wearable devices), we may exchange data as necessary to provide integrated wellness insights.

· With service providers: Including cloud storage providers, analytics services, and other vendors who assist us in operating our Services, but only to the extent necessary and under strict confidentiality agreements.

· With your consent: We may share your data when you explicitly consent to specific sharing practices.

· For legal reasons: When required by law, court order, or to protect rights, safety, or property

· With potential purchasers: In connection with or during negotiation of any reorganization, merger, acquisition, financing, or sale of all or a portion of our assets. We cannot promise that an acquiring party or the merged entity will have the same privacy practices or treat your information the same as described in this Policy.

We do not “sell” consumer health data as defined in applicable law.

4. Security of Consumer Health Data

We implement appropriate technical and organizational safeguards to protect your consumer health data against unauthorized access, disclosure, alteration, and destruction. These measures include:

· Encryption of consumer health data in transit and at rest.

· Access controls limiting employee access on a need-to-know basis.

· Regular security assessments and updates.

· Secure cloud infrastructure.

· 30-day data retention period for AI processing (after which data is deleted or anonymized).

5. Your Rights Regarding Consumer Health Data

You have the following rights regarding your consumer health data:

· Right to Access: You may request a copy of the consumer health data we maintain about you.

· Right to Deletion: You may request that we delete your consumer health data, subject to certain legal exceptions.

· Right to Correction: You may request that we correct inaccurate consumer health data.

· Right to Data Portability: You may request your consumer health data in a portable format.

· Right to Withdraw Consent: You may withdraw your consent for our collection and use of your consumer health data at any time.

· Right to Opt-Out: You may opt-out of certain uses of your consumer health data, including AI processing, noting however that such opt-out may remove access to certain features of our Services.

· Right to Appeal: If we deny your request you have the right to appeal our decision.

6. How to Exercise Your Rights

To exercise these rights, please contact us at privacy@existence.io. We will respond to your request within the timeframe required by applicable law. If we deny your request, you may appeal by emailing us again at privacy@existence.io within 30 days of our denial.

7. Consent Requirements

· Collection: We will only collect your consumer health data with your affirmative, voluntary consent, which we obtain when you create an account and connect health data sources.

· Sharing: We require separate, specific consent before sharing your consumer health data with any third parties beyond what is described in this Policy or necessary to provide our Services.

· AI Processing: By using our Services, you consent to AI processing of your health data to generate wellness insights. You may opt-out of AI features at any time by contacting us as noted above.

· Sale: We do not sell consumer health data under any circumstances.

8. Prohibited Practices

We do not and will not:

· Discriminate against you for exercising your rights under this Policy.

· Use consumer health data for purposes unrelated to wellness insights and service improvement.

· Share consumer health data for marketing or advertising purposes.

· Use your health data to make decisions that could have legal or similarly significant effects.

9. Data Retention

We retain consumer health data only as long as necessary for:

· Providing ongoing wellness insights and Services.

· Maintaining your account and historical wellness trends.

· Legal obligations and compliance requirements.

· Resolving disputes and enforcing our agreements.

10. Processors and Third Parties

Any third-party processors who handle consumer health data on our behalf are contractually required to:

· Process data only as instructed by Existence.

· Implement appropriate security measures.

· Not use the data for their own purposes.

· Assist us in responding to consumer requests.

· Delete or return data upon termination of the services.

11.  Changes to this Policy

We will update this Policy when necessary to reflect changes in our practices or applicable law. When we post changes, we will revise the “Effective Date” at the top of this Policy and notify you of material changes through our Services or via contact information you provide to us.
