This Privacy Policy describes how Existence LLC ( “Existence”, “our”, “us”, and “we”) collects, uses, shares and protects personal information when you interact with our websites (www.existence.io) or mobile apps, emails we send, social media accounts, and online services (collectively, our “Services”). We never sell your personal information. We do not use your calendar data, health data, or wellness information for advertising purposes. This Privacy Policy explains the following:

Please note that this Privacy Policy does not apply to non-Existence websites or any other services that state that they are offered under a different privacy policy. Please review the privacy policies on those websites and applications directly to understand their privacy practices.

1. The Personal Information We Collect. Depending on the nature of your interaction with Existence, we may collect personal information as follows:

1.1 Directly from you, when you provide information to us or interact with us:

(a) Contact information and any other information you choose to include when you communicate with us via e-mail, mail, phone or other channels.

(b) Profile and subscription information, such as a username and password, your name, mailing address, e-mail address, phone number, date of birth, and usage and subscription preferences, which may include signing up to some of our Services or communications from us.

(c) User Content you may provide via the Services, including photos videos, energy ratings, wellness notes, and time/activity classifications.

(d) Transactional information including payment information and payment history if you engage in transactions through the Services.

(e) Any additional information you choose to provide us, including questions and feedback.

1.2 Automatically from you, when you utilize or interact with our Services: Device information and online user activity when you utilize our technology platforms, as described in the next section.

1.3 From third parties: If you choose to connect your account on our Services to your account on another service, we may receive information from the other service. This includes:

(a) Calendar data from Google Calendar API, which may inadvertently contain personal information such as appointment details, location data from calendar events, or other personal information you include in calendar entries. We do not use geofencing technology or extract geolocation coordinates from calendar entries to identify your presence at healthcare facilities or for health tracking purposes.

(b) Information about your interests, contact information, demographic information, and marketing inferences, from third party sources that provide consumer data, social networks, and other sources of publicly available data.

(c) Information about the marketing and advertisements you have seen or clicked on, from online advertising companies.

1.4 Google API Limited Use Disclosure. Existence’s use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy, including the Limited Use requirements. Specifically:

(a) Prohibited AI Training: We do not use data obtained through Google API Services, including any aggregated, anonymized, or derived forms of such data, to train generalized or non-user-specific artificial intelligence or machine learning models.

(b) Transfer Restrictions: We only transfer Google API data to third parties (such as our AI service providers) as necessary to provide or improve user-facing features that are visible and prominent in the Services, and only if those third parties are contractually required to adhere to the Google API Services User Data Policy, including its Limited Use requirements, in full. This includes prohibitions on using such data for advertising, data brokering, model training, or any purpose beyond providing the specific services requested by Existence. Where such data is de-identified prior to transfer, these restrictions continue to apply to the de-identified, aggregated, and derived forms of such data.

(c) Attendee Lists: We access meeting attendee lists solely to provide “Social Energy” insights—calculating the wellness impact of your collaborative density versus solitary recovery time.

(d) Use: For data obtained through Google API Services, including any aggregated, anonymized, or derived forms of such data, we only use such data to provide and improve user‑facing features that are clearly described in our Services (such as calendar‑based time insights and social energy analytics), and never for marketing, advertising, business development, or generalized model training purposes.

Some of this information may be collected by external parties on our behalf. For example, we use a payment processor when you engage in a transaction on our website; Existence does not itself collect or store payment card information.

2. How We Use Artificial Intelligence.

We use artificial intelligence (“AI”) and machine learning technologies to analyze your data and provide personalized wellness insights. This section describes how AI is integrated into our Services:

2.1 AI Processing.

(a) We use third-party AI service providers to process your health, sleep, calendar, and activity data to generate personalized insights and recommendations.

(b) AI analyzes patterns across our four pillars (life, health, sleep, and work) to help you optimize time and energy.

(c) User-generated content like photos and videos may be processed by AI to provide relevant insights.

(d) For the avoidance of doubt, data obtained from Google API Services, including any derived, aggregated, or de-identified forms of such data, will not be used to train generalized or non-user-specific artificial intelligence or machine learning models or for advertising or marketing.

2.2 AI Limitations.

(a) AI-generated insights are for informational purposes only and are not medical advice. Existence does not use AI to make “automated decisions” that produce legal or similarly significant effects concerning the user, such as affecting your insurance eligibility, employment status, or creditworthiness.

(b) AI outputs may not always be accurate or complete.  All AI-generated wellness insights and summaries provided through our Services are visually labeled to identify them as AI-generated content.

(c) We recommend reviewing AI-generated insights critically and consulting professionals for important decisions.

2.2 Your Control.

(a) AI-generated insights, summaries, and chat conversations within your account are retained as part of your account data for as long as your account is active. You may delete individual chat conversations at any time, and all data is deleted upon account deletion or upon request.

(b) To the extent your data is disclosed to or processed by an AI service provider, such data will be protected and retained in accordance with the AI service provider’s applicable policies. We do not control any AI service provider policies or practices but require, where commercially reasonable, that such AI service providers process personal information solely on our behalf and delete or anonymize such information in accordance with their contractual obligations and applicable law. We do not sell or share personal information with such AI service providers for cross-context behavioral advertising purposes.

(c) You maintain ownership of your content; we only use it to provide Services and improve our AI systems using anonymized, aggregated data.

(d) Your data is never used to generate AI insights, train models, or inform outputs delivered to other users of the Services. All AI processing is confined to your account environment. We do not build shared behavioral models from your personal data that are applied to other users, and we do not incorporate your data into any cross-user learning that affects the outputs other users receive.

3. Online User Activity, Cookies and Information Collected by Other Automated Means.

3.1 Automatic Collection. When you interact with the Services, certain information about your use of our Services is automatically collected. This includes:

(a) Usage Details about your interaction with our Services (such as the date, time, and length of visits, and specific pages or content accessed during the visits, search terms, frequency of the visits, referring website addresses);

(b) Device Information including the IP address and other details of a device that you use to connect with our Services (such as device type and unique device identifier, operating system, browser type, mobile network information, and the device's telephone number); and

(c) Location information where you choose to provide the website with access to information about your device’s location.

3.2 Tracking. Much of this information is collected through cookies, web beacons, and other tracking technologies, which may be operated by our partners who assist us in collect information about usage of the Services, serving ads, or providing other services to you. For example, we use Google Analytics to collect usage details. You can learn more about privacy and Google Analytics by visiting https://support.google.com/analytics/answer/6004245, and opt out of collection of your data by using the Google Analytics Opt-out Browser Add-on, available at https://tools.google.com/dlpage/gaoptout. We may also use cookies set by other third-party services. Google Analytics operates independently of our use of Google API Services. Data collected via Google Analytics cookies is not combined with data obtained through Google API Services and is not used to expand our access to or uses of Google user data obtained via Google APIs.

3.3 Opt-Out. You may be able to opt out tracking by cookies or control how information collected by cookies is used via a number of means:  Your browser or device may include “Do Not Track” functionality; please note that we do not respond to such signals. We do not sell or share personal information for targeted advertising, and we do not currently operate online advertising that would be subject to Global Privacy Control (GPC) signals. If we introduce such advertising in the future, we will update this Policy and honor GPC signals at that time.

4. How We Use Your Personal Information.

4.1 Purposes. We use the personal information we collect from you for the following purposes:

(a) Provide our Services to you, including maintaining your account, managing any purchases or transactions, and providing information related to the products and services you have purchased. We also use your information to make inferences. Here are some examples:

(i) Based on your sleep data that we obtain from third parties you connect to the Services, we may make inferences about your sleeping patterns and provide you with customized insights to help you improve your sleep and daily rhythm.

(ii) We may personalize goals and strategies for effectively designing time, managing energy and maximizing joy based on the goals you previously set and your historical data (calendar, activity, etc.) submitted to the Services.

(iii) We analyze your data across our four pillars (life, health, sleep, and work) to provide insights about your time allocation and energy patterns.

(iv) We may use AI to process your combined data sources to generate personalized wellness recommendations and insights.

(b) Interact with you, including responding to your requests, providing customer support, providing information about additional products, services, and promotions that may be of interest to you, and informing you about important changes to this Privacy Policy, our Terms of Service, or other policies.

(c) Tailor the content we display to you in our Services and communications, including advertising.

(d) Manage, operate, and improve the Services and grow our business, including monitoring the performance of our Services, understanding our customer base and the effectiveness of our marketing, events, promotional campaigns, and publications, developing new products and services, improving our AI models and algorithms, and diagnosing or fixing technology problems.

(e) Comply with legal requirements and industry standards, detect, investigate, and prevent activities that may violate our policies or be fraudulent or illegal, and protect the rights of Existence, you, or others.

4.2 Aggregated or De-Identified Data. We may use aggregated or de-identified data for research, analysis, modeling, and improvement of our Services. We do not use data obtained from Google API Services, including any aggregated, anonymized, or derived forms of such data, for marketing, advertising, or business development, and we only use such data to provide or improve user-facing features within the Services. Where such aggregated or de-identified data does not include or derive from Google API Services or consumer health data, we may also use it for limited marketing and business development purposes.

5. How We Share Your Personal Information.

5.1 Service Providers. We may share your information with third-party service providers that we believe need the information to perform a technology, business, or other professional function for us such as billing and collection, IT services, maintenance and hosting of our Services, payment processors, marketing partners, accounting, auditing, and tax services, AI and machine learning services, and other professional services.

5.2 Analytics Partners. We partner with analytics providers, who collect information via tracking technologies on our websites to assist us with measuring visits and traffic on our websites so we can measure and improve the performance of the sites.

5.3 Advertising Partners. We partner with third parties who assist us in serving advertising regarding the Services to others who may be interested in the Services, or who use cookies to display interest-based advertising to you on the Services. These third parties may use tracking technologies to collect or receive information from the Services and elsewhere on the internet and use that information to provide measurement services and target ads. Third parties may allow other companies to access information about you so that they may market other products you may be interested in. We maintain strict data separation controls for data obtained through Google API Services. Such data is never combined with advertising datasets, used for audience segmentation, or incorporated into advertising profiles or targeting systems.

5.4 AI Service Providers. We share your data with third-party AI service providers who process your information to generate wellness insights and recommendations. Where AI service providers process data obtained through Google API Services, they act solely as our processors, are contractually prohibited from using such data to train, improve, or develop generalized or non-user-specific models, and must comply with the Google API Services User Data Policy, including its Limited Use requirements.

5.5 Social Media Platforms. If you interact with us on social media platforms, the platform may be able to collect information about you and your interaction with us. To control this sharing of information, please review the privacy policy of the relevant social media platform.

5.6 Affiliates. We share information with other entities in our corporate family, for purposes consistent with this Privacy Policy.

5.7 Corporate Event. We reserve the right to transfer to another entity or its affiliates or service providers some or all information about you in connection with, or during negotiations of, any merger, acquisition, sale of assets or any line of business, change in ownership control, or financing transaction. In the event of a merger, acquisition, change in ownership control, or sale of assets, we may transfer your information to the successor entity. However, for any data obtained through Google API Services, we will obtain your explicit prior consent before transferring such data to a third party in connection with a corporate event. For all other data, we cannot promise that an acquiring party or the merged entity will have the same privacy practices or treat your information the same as described in this Privacy Policy, but we will provide notice before your personal information is transferred and becomes subject to a different privacy policy.

5.8 Legal. We share information where necessary to comply with applicable law, to respond to requests from law enforcement agencies or other government authorities or third-parties, as permitted by law and without your consent when it is necessary to protect our customers, employees, or property; in emergency situations; or to enforce our rights under our Terms of Service and policies.

5.9 Service Provider Requirements. All service providers that process personal data on our behalf are contractually required to: (a) process such data solely for the purpose of providing services to Existence; (b) not retain such data longer than necessary to perform such services; (c) not use such data to train, improve, or develop generalized or non-user-specific artificial intelligence or machine learning models; (d) not disclose such data to any third party except as strictly necessary to perform contracted services; and (e) implement appropriate technical and organizational safeguards to protect such data.

5.10 Google API Services Data. For data obtained through Google API Services, we share such data only with service providers that are strictly necessary to provide or improve user-facing features that depend on Google integrations (such as calendar-based insights), and only under contracts that require adherence to the Google API Services User Data Policy, including the Limited Use requirements, and prohibit any use of such data for advertising, model training, or unrelated analytics.  Data obtained through Google API Services is not shared with analytics or advertising partners, is not combined with analytics, advertising, or marketing datasets, and is never used for audience segmentation or analytics unrelated to your direct use of the Services, or to target, measure, or personalize advertising.

5.11 No Sale. We do not sell your personal information as that term is defined under applicable law, including the California Consumer Privacy Act.

6. How We Protect and Store Your Personal Information.

6.1 Security. We use a combination of physical, technical, and administrative safeguards to protect the information we collect through the Services. While we use these precautions to safeguard your information, we cannot guarantee the security of the networks, systems, servers, devices, and databases we operate or that are operated on our behalf. We implement industry-standard encryption for data in transit and at rest, and maintain strict access controls for consumer health data.

6.2 Google API Services Data. With respect to data obtained through Google API Services specifically, human access to such data is strictly prohibited except in the following limited circumstances: (a) you have provided affirmative agreement to allow us to view specific data (e.g., in connection with a customer support request); (b) access is necessary for security purposes, such as investigating a bug or potential abuse; (c) access is necessary to comply with applicable law; or (d) the data has been aggregated and anonymized and is used only for internal operations in accordance with applicable law.

6.3 Location. If you use our Services outside of the United States, you understand that we may collect, process, and store your personal information in the United States and other countries.

7. Retention of Your Personal Information.

We will retain your personal information for as long as is necessary to complete the purposes for which it was collected, or as may be required by law. Data processed through AI service providers for insight generation is retained in their active processing environments for a limited period pursuant to their own policies (typically up to 30 days), after which it is deleted or anonymized, consistent with our contractual. AI-generated insights, summaries, and conversation records within your account are retained as part of your account data for as long as your account is active and deleted upon account closure or valid deletion request.

8. Your Privacy Options.

Existence applies the privacy rights described in this Section 8 to all users regardless of their location. We do not limit these rights to residents of specific states or countries. You may have certain choices when it comes to how we collect and use your personal information and each of the following options is considered a "privacy request" under this Policy:

8.1 Account Information. Please visit your account to update your personal information and payment method. Where required by law, we will obtain your explicit consent before processing certain categories of data using AI.

8.2 Email Marketing. If at any time you no longer wish to receive marketing communications from us, you can click the unsubscribe link at the bottom of any email or email us at: privacy@existence.io.

8.3 Health Data. If you connect a health data source in the future, you can manage and revoke access at any time through your account settings or the third-party service.

8.4 Limit the Use of My Sensitive Personal Information. Residents of certain states, including California, have the right to limit our use of 'Sensitive Personal Information' (such as sleep and health metrics) to only those uses necessary to provide the Services. You may exercise this right by emailing privacy@existence.io.

8.5 Online Activity Tracking and Interest-Based Advertising. You have several options to either prevent our collection of information regarding your online activity, or prevent third parties from using such information from being used for interest-based advertisements:

(a) You may modify your browser setting to disable or reject cookies across the internet; but if you do so, some features of our website or Services may not function properly or be available. If you are visiting the Services from a mobile device, the operating system of the device may offer you options regarding how the device collects and uses your information for interest-based advertising. Please visit https://thenai.org/opt-out/mobile-opt-out/ for more information.

(b) You may be able to prevent third parties from using your information for interest-based advertisements across the internet by visiting http://www.networkadvertising.org or http://www.aboutads.info. Please note this does not opt you out of being served ads, nor will it prevent the receipt of interest- based advertising from other companies that do not participate in these programs.

8.6 SMS Marketing. Consent to receive automated marketing text messages is not a condition of any purchase. You can opt-out of receiving commercial text messages via by responding to any of our text messages with any of the following replies: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT. If you opt-out, we may still send you messages regarding the status of your orders and other service-related communications.

8.7 Right to Appeal. If we deny your privacy request (as defined above), you have the right to appeal our decision within 30 days by emailing privacy@existence.io. We will respond to your appeal in writing within the timeframes required by applicable law.

9. Children’s Information.

We do not knowingly or intentionally gather personal information about children. Our Services are intended for users who are 18 years of age or older, consistent with our Terms of Service. We do not knowingly or intentionally gather personal information about children under the age of 18. If we have inadvertently collected the personal information of a user who is under 18 years of age, a parent or guardian may contact us at privacy@existence.io to request that we delete the information from our records or otherwise cease the use of that information. Upon receiving such a request, we will promptly verify and, where confirmed, delete the data and terminate the associated account.  

10. Updates to This Privacy Policy.

PLEASE NOTE THAT THIS POLICY IS SUBJECT TO CHANGE BY EXISTENCE IN ITS SOLE DISCRETION AT ANY TIME.  When changes are made, Existence will make a new copy of this Policy on its website.  The “Effective Date” at the top of this page indicates when this Policy was last revised. If we make material changes to this Policy, we may (and, where required by law, will) also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via e-mail if you have an Account or another manner through the Services (which may include posting an announcement on our website). We may also notify you in other ways from time to time about the collection, use, and disclosure of your personal information described in this Policy.
